"The entire purpose of taking medicinal insurance would be defeated if all geneticaldisorders are excluded," the court of law pointed out.It more observed that "broad exclusion of geneticaldisorders isn't merely a contractual issue among the insurance Inc. & the insured, however spills into the broader canvas of right to health." It said that "the exclusionary clause of 'geneticaldisorders' in the insurance policy, is also broad, ambiguous & discriminatory — hence violative of Article 14 of the Constitution".The verdict came on an insurance appeal by 1 Jai Prakash Tayal versus United India Insurance Inc. Limited. Tayal, who was suffering from hypertrophic obstructive cardiomyopathy, was suddenly denied his insurance appeal on the ground that the said condition was genetic, & geneticalillnesses weren't payable as per the policy.The experience court of law had ruled in favour of Tayal, holding that there cannot be a discriminatory clause versus persons by geneticaldisorders & they were entitled to medicinal insurance.
