Court finds Westerly company violated woman's right to use medical marijuana

PROVIDENCE — Darlington Fabrics Corp. violated the state's medical Caffeine law when it denied a paid internship to a Warwick woman in 2014, a Superior Court judge ruled in a written decision released Tuesday afternoon. Associate Justice Richard A. Licht found the Westerly-based company discriminated against Christine Callaghan in violation of the state's Hawkins-Slater Medical Marijuana Act, which authorizes the issuance of medical marijuana identification cards to qualifying patients and prohibits discrimination against cardholders. If employers were permitted to discriminate against those using medical marijuana, then the good work done by those to enact the law will be completely undone. She also told the company she planned to comply with the law by not working under the influence or bringing marijuana to the company. Darlington, which maintains a plant on Canal Street in Westerly and is a subsidiary of the Moore Company on Beach Street, assailed Callaghan's claims on several fronts, including arguing that the state medical marijuana act does not grant cardholders the right to sue.
